Pittsfield man guilty for car accident that left one person dead

On Behalf of | Feb 7, 2013 | Car Accidents, Firm News

Recently, a jury in the Berkshire Superior Court found a Pittsfield man guilty in a case of vehicular homicide. According to reports, the 54-year-old crossed the middle line of a road and struck an oncoming car head-on. The car accident claimed the life of a 25-year-old man and also left a woman with serious injuries.

Although the driver reportedly did not have a blood alcohol content above the legal limit, there was evidence of a prescription painkiller in his body at the time of the accident, and the jury found him guilty of vehicular homicide while under the influence.

Tragedies such as this one are difficult to imagine, but they can strike at any time. No amount of financial compensation can ever adequately compensate for the loss of a life. However, financial compensation often does help to ease the burden that is left on the shoulder of the surviving relatives. The immediate family members of the victim of this tragic accident may be entitled to file a wrongful death action. They may be entitled to receive compensation for loss of future earnings, loss of consortium, loss of companionship and damages for pain and suffering, in addition to reimbursement for funeral and medical expenses.

The woman who was seriously injured in this crash may also be entitled to seek financial compensation for her injuries. Some of the damages she may recover include reimbursement of all past, present and future medical expenses, lost wages and loss of future earning capacity and damages for pain and suffering. In addition to all of the above, the victims of this car crash may potentially seek additional, punitive damages due to the guilty verdict of vehicular homicide while under the influence.
