Woman suffers serious injuries in pedestrian accident

Massachusetts residents should be able to go about their everyday lives without fear of harm. Unfortunately, as most of us are probably aware, this is not reality. Instead, people find themselves at risk of being harmed at some of their most vulnerable times. Walking, for instance, should be a relatively safe activity. Yet, when crossing a road, it only takes the blink of an eye for an errant driver to turn that routine walk into a living nightmare.

Sadly, one Massachusetts woman fell victim to one of these tragic pedestrian accidents. She was attempting to cross the street at night when she was hit by a car, which then rolled up on top of her. A jack was needed to remove the woman from under the vehicle. She remains in critical condition.

No charges have been filed against the driver who struck her, though the investigation is ongoing. Police state that the woman was in a crosswalk at the time of the accident, but initial reports suggest bad weather may have played a role in the wreck.

An accident like this can have a long-lasting impact on a victim. He or she may be subjected to life-long pain and suffering and perhaps even permanent disability. Additionally, medical expenses incurred to treat a serious injury can accrue and wages can be lost, leaving the victim in a precarious financial situation.

The good news is that, even if criminal charges are not brought against an errant driver, a victim can still file a lawsuit against him or her. The criminal and civil legal systems adhere to differing burdens of proof, meaning that an individual can be ordered to pay compensation for a victim’s damages, even if he or she was found innocent in a criminal court. Thus, individuals who have been hurt in a car accident should speak with an attorney to assess their legal options.
