Negligent maintenance can lead to a truck accident

Massachusetts residents understand the importance of taking care of their personal vehicles, not just to keep them in running condition, but for safety reasons. Similarly, proper maintenance of semi trucks is critical not only for the trucker's safety, but also the safety of other motorists on the road. Because of this, the Federal Motor Carrier Safety Administration has established regulations in hopes of ensuring that all big rigs on the road are safe.

According to these regulations, each motor carrier must inspect, repair, and maintain all of its vehicles. All component parts of the vehicle must be maintained in a safe operating order, including the steering system, tires, axles, and suspension systems. Truck companies must keep records of these inspections and any work done on a truck. These records, as well as the trucks themselves, may be subject to inspection.

Trucks that are deemed unsafe for operation must be pulled from service. If a truck is found to be unsafe while being driven, then the trucker can operate the vehicle to the nearest place of repair. Those who fail to abide by these regulations may be placing individuals at serious risk of harm.

Those who are injured in a truck accident caused by a negligent driver or an improperly maintained truck have the right to recover damages. By filing a personal injury lawsuit, a victim may be able to recover much-needed compensation for medical expenses, rehabilitation costs, lost wages and pain and suffering. However, the legal process can be complex and confusing. Thus, victims should carefully consider whether legal representation will help them protect their rights.
